A bounced cheque is not just a financial loss — it becomes a criminal offence under Section 138 of the Negotiable Instruments Act.
That means a defaulter can face:

  • Jail punishment

  • Heavy fine

  • Court summons

  • Seizure of salary/assets if order not followed

But most people don’t follow the proper legal process, so the case becomes weak.

Correct procedure:

  1. Cheque returned → take bank return memo

  2. Send legal notice within 30 days to the issuer

  3. If no payment within 15 days → file 138 NI Act case

  4. Submit bank proof + notice + delivery proof + cheque copy

Most defaulters repay immediately after receiving the court summons — because they fear criminal consequences.
